Aditya Pancholi Convicted In 20-Year-Old Parking Assault Case, No Jail Time Given. Here’s Why

A Mumbai sessions court has upheld actor Aditya Pancholi’s conviction in a 2005 parking assault case but modified his one-year jail sentence, ordering his release on a bond of good behaviour. The court directed the 59-year-old actor to pay Rs 1.5 lakh in compensation to victim Pratik Pashine under the Probation of Offenders Act.

Actor Aditya Pancholi gets relief from jail term

In November 2016, a Metropolitan Magistrate (Andheri) convicted Pancholi under IPC Section 325 (voluntarily causing grievous hurt) and sentenced him to one year in jail for assaulting Pashine over a parking dispute. Pancholi later appealed against the conviction and sentence.

On Thursday, Additional Sessions Judge D.G. Dhoble partly allowed his appeal, sparing him from serving jail time. The sessions judge stated that the trial court "has not committed any illegality, irregularity and perversity" in convicting the accused and sentencing him to a one-year jail term.

"The impugned judgment and order '...convicting the appellant under Section 325 IPC is hereby upheld. But instead of awarding sentence of substantial punishment, I hold that the accused is entitled to be released on probation of good conduct under Section 4 of the Probation of Offenders Act," the sessions court ruled.

Aditya Pancholi’s 2005 parking assault case

The judge ordered the actor's release upon furnishing a Rs 15,000 bond and signing an undertaking to maintain peace and good behaviour for a year, refraining from any criminal activities. The sessions court also stated that the magistrate would have the liberty to take appropriate action if the conditions were violated.

According to the case filed at Versova police station in August 2005, the actor allegedly assaulted and threatened his neighbour during a heated dispute over a parking space.
