NC Moves SC Challenging Presidential Order On Article 370
The NC also sought to declare the Jammu and Kashmir Reorganisation Act, 2019 as "unconstitutional".
New Delhi: The Jammu and Kashmir National Conefernce on Saturday moved the Supreme Court challenging the Presidential Order abrogating Article 370 which revoked the special status given to Jammu and Kashmir. The petition was filed by NC leader Mohammed Akbar Lone and Hasnain Masoodi.
The petitioners who sought a direction from the apex court to declare the Presidential as "unconstitutional, void and inoperative" in Jammu and Kashmir.
The NC also sought to declare the Jammu and Kashmir Reorganisation Act, 2019 as "unconstitutional".
A Kashmiri lawyer has also moved the apex court challenging the Presidential order. Advocate Shakir Shabir in his petition claims that the Presidential Order that amended Article 367, which resulted in the revocation of J&K's special status, could not have been amended without the concurrence of the state Assembly and was ultra vires the Constitution.
The plea contended that the approval of the state Assembly reflected the will of the people, which was required before effecting such sweeping changes that altered the history and geography of J&K.
On Monday, India revoked Article 370 to withdraw the special status to Jammu and Kashmir and bifurcated the region into two Union Territories - Jammu and Kashmir, and Ladakh.
