Bihar Court Acquits Juvenile For Scoring Well In Matriculation Examination

During interrogation, the juvenile applied for bail from Judge Manvendra Mishra for further studies. Kishor had promised the court that he would score good marks in the matriculation examination.

Nalanda: Parents and relatives often reward their children for scoring good marks in the examination. This is a common practice. But a shocking case has come to the fore in Bihar. The case is of the Nalanda district, where the Principal Magistrate of the Juvenile Justice Council has given a unique reward to the juvenile for getting good marks in matriculation. Principal Magistrate Manvendra Mishra, who is often in the headlines for his unique decisions, gave another unique verdict on Tuesday.

Juvenile had made a promise to the judge

After the Juvenile's decent performance in the Bihar Board matriculation examination, the judge not only acquitted him but also, took over the responsibility of bearing his educational expenses. According to the judge, he will bear the entire cost of the juvenile's intermediate education. The juvenile was accused in the assault case. The court had granted him bail for studies. Kishore promised that he would score well in the matriculation examination. He fulfilled his promise, after which the court acquitted him as a reward. 

Along with the acquittal, the judge has ordered the concerned BDO to extend the benefits of the aftercare scheme to the child. The judge also ordered the District Child Protection Unit to provide government assistance to the family members. According to the information received, the accused teenager is from a Mahadalit family. He has seven sisters and two brothers. The father is neurotic and the mother is often ill. The financial condition of the house is bad.

Due to difficult circumstances at home, Kishor had expressed his desire to pursue further studies by applying in court. The judge called for all the reports related to his family from the Deepnagar police station. On verifying the information provided by Kishore, he acquitted him and took the responsibility of bearing his educational expenses.

Why was Juvenile convicted?

Assistant Prosecution Officer Jaiprakash said that on May 27, 2019, there was a fight between two parties over a drain dispute in a village that is under the jurisdiction of Deepnagar police station. The informant Bhagirath Prasad had lodged an FIR against 35 people including the two brothers. Both the accused were present at the scene and were arrested by the police and sent to jail as adults.

In the year 2019, when the matter came before the Juvenile Justice Council, during interrogation, the juvenile applied for bail from Judge Manvendra Mishra for further studies. The Juvenile had promised the court that he would score good marks in the matriculation examination. The child had said that he would accept every decision of the court if he did not score good marks.
