Atul Subhas Suicide: Nikita Singhania, Mother Nisha Approach Court For Pre-Arrest Bail

Nikita Singhania and her family members, who are co-accused in the Atul Subhash suicide case, have filed anticipatory bail applications in the Allahabad High Court.

Atul Subhash Suicide Case: Nikita Singhania, the widow of Artificial Intelligence engineer Atul Subhash Modi, who killed himself accusing his wife and in-laws of harassment, has filed an application for anticipatory bail in Allahabad High Court. Three others, who are co-accused in the Atul Subhash suicide abutment case have also filed pleas for anticipatory bail. 

The Bengaluru Police had named Nikita Singhania, her mother Nisha Singhania, her brother Anurag Singhania, and her uncle Sushil Singhania as accused in the case. All the four accused filed the anticipatory bail pleas on Friday, December 13. The anticipatory bail application could be heard in the Allahabad High Court on Tuesday or Wednesday (December 17 or 18).

However, Nikita Singhania's family is preparing to approach the high court on Monday demanding an urgent hearing.  They are likely to request the anticipatory bail on the same day. The Singhania family is learnt to have engaged several senior lawyers to present their case in the court.

On the other hand, there is no information about Atul Subhash's family filing a caveat in the high court. A caveat is a plea to the court for information to the person filing the plea to be apprised before any action is taken on certain matters.

Atul Subhash, before killing himself by suicide on December 9 had accused the Singhania family and a sessions court judge of harassing him for money. The Singhanias had allegedly demanded Rs 40,000 per month for maintenance but later increased the claim to Rs 1 lakh.  In his 24-page suicide note, he also accused the judge of demanding a bribe to settle the case. He also accused the Singhanias of demanding Rs 3 crore to settle the case.

The incident shocked the nation as outrage poured in from all corners, demanding the Singhania family's arrest.

Amid the growing calls for justice, the Supreme Court, too, expressed concern over the misuse of cruelty laws by married women to harass their husbands and in-laws for selfish reasons. A Bench of Justices BV Nagarathna and N Kotiswar Singh noted that the law initially meant to protect women from domestic violence, is sometimes being exploited to force compliance with "unreasonable demands".
