'Don't Unnecessarily Adjourn': A Day After Calling Delay In Kejriwal's Case 'Unsusal', SC Urges HC To Decide On Satyendar Jain's Bail

A day after calling Delhi High Court's move to reserve order on jailed Delhi CM Arvind Kejriwal's bail plea 'unusual,' the Supreme Court on Tuesday urged the high court to decide on former Aam Aadmi Party (AAP) minister Satyendar Jain's bail plea on July 9 and to not keep it unnecessarily adjourned.

A Vacation Bench of Justices Manoj Misra and SVN Bhatti while hearing Jain's plea challenging the Delhi High Court's order that adjourned his default bail plea to July 09, observed that bail applications are not to be unnecessarily adjourned.

The top court while passing the order today expressed the hope that the Delhi High Court would decide the default bail plea of the AAP leader without delay.

"It goes without saying that bail prayers are not unnecessarily adjourned and thus we hope and trust that the High Court takes a call in the matter when it is listed next," the top court said.

Senior Advocate AM Singhvi, appearing for Jain, told the court that the challenge was essentially an order of adjournment.

"The High Court could not have given a long adjournment of six weeks," Singhvi contended.

Singhvi furthertold asked the court whether an incomplete charge sheet can be filed by the ED to defeat the right of default bail.

He further told the court that this question of law is under consideration before a three-judge bench of the Supreme Court and requested that Jain's petition be tagged along with those petitions.

After hearing Singhvi's submission, the top court said that since a three-judge bench is considering the point of law, they cannot deal with the issue and suggested that Jain wait for the final decision of the High Court.

The former AAP minister was arrested by ED in May, 2022 under the charges of money laundering under the Prevention of Money Laundering Act (PMLA).
