SC Targets Netflix, Prime Video, Ullu, X, More In Crackdown On Obscene Content, Issues Notice To OTT & Social Media Giants

The Supreme Court has taken a significant step by issuing a notice to the Centre, leading OTT platforms like Netflix, Amazon Prime, Ullu, ALTT, and social media giants like X (formerly Twitter), Facebook, Instagram, and YouTube. The notice follows a Public Interest Litigation (PIL) that urges the Government to implement effective measures to curb the streaming of obscene content on these platforms.

SC Highlights Urgency of the Matter

The PIL brings to light growing concerns over the prevalence of sexually explicit content on digital platforms, specifically OTT services and social media. The petitioners have called for immediate regulation to prevent such content from being freely accessible to users, including minors. The Supreme Court, acknowledging the serious nature of the issue, pointed out that the responsibility to regulate such content lies with either the executive or the legislature.

The Centre must take appropriate steps to tackle the issue at hand, the Court remarked, addressing the Government’s role in controlling what is being disseminated through these platforms.

Platforms Under Scrutiny

The notice, which covers a wide array of prominent digital platforms, signals a heightened scrutiny of the type of content being made available online. OTT platforms such as Netflix and Amazon Prime, along with regional streaming services like Ullu and ALTT, are now under the Supreme Court's radar. The petition also focuses on social media platforms, including Facebook, Instagram, X, and YouTube, which host user-generated content that could potentially violate the legal framework surrounding pornography.

The petitioners argue that while these platforms claim to adhere to content guidelines, there is a substantial lack of enforcement, allowing explicit material to proliferate. This has led to public outrage, with many calling for stricter regulations to safeguard viewers, particularly children, from exposure to inappropriate material.

Supreme Court's Stance: An Important Concern

In its ruling, the Supreme Court underscored that the issue raised by the petition is of “significant concern” due to the easy accessibility of explicit content. While the Court has issued a notice, it has also emphasised that any potential action would need to be taken in coordination with the Government and the relevant legislative bodies.

As the case develops, the Centre will be expected to address the challenge of regulating content across these widely used platforms. The Court’s involvement reflects a growing acknowledgement of the need for stronger oversight in an increasingly digital world.
