The Supreme Court will now look into the question whether MLA Abbas Ansari should get bail in a case registered against him for meeting his wife illegally in office of the prison superintendent in Chitrakoot jail in Uttar Pradesh.
The top court on Thursday issued notice to Uttar Pradesh government on Ansari's bail plea.
Senior Advocate Kapil Sibal appearing for Ansari informed the court that Section 387 of IPC has also been invoked against Ansari in this case.
In May, the Allahabad high court rejected the bail application of the Mau (Sadar) MLA, noting that if a can influence jail authorities then he can also influence witnesses in the case after coming out on bail.
Abbas Ansari is accused of illegally meeting his wife Nikhat in the office of the prison superintendent of Chitrakoot jail. Reportedly, the meetings between the husband and wife used to last for several hours.
They were caught after a sudden raid carried out by senior officials of Chitrakoot, on February 11, 2023. His wife, Nikhat Ansari was also arrested during the raid from the VVIP guest room adjacent to the jailor’s office in the Chitrakoot jail.
It is alleged that Nikhat Ansari used to meet Abbas for three-four hours at least thrice a week in Chitrakoot jail and her visit was facilitated by jail authorities.
It was also found that her visits were not logged into the jail register.
After the incident came to light, Abbas Ansari who is son of late gangster-politician Muktar Ansari, was shifted from the Chitrakoot prison to Kasganj district jail in February 2023 after the incident.
In August 20203, Nikhat Ansari had secured bail from the Supreme Court in the said case.
