SC orders restoration of Congress government in Arunachal Pradesh

New Delhi: In a huge setback for the Narendra Modi government, the Supreme Court on Wednesday directed the restoration of ousted Arunachal Pradesh Chief Minister Nabam Tuki as it quashed the decision of Governor Jyoti Prasad Rajkhowa preponing the state assembly session in December 2015. The apex Court today declared the Governor's decision of dismantling the Nabam Tuki government as 'illegal'. Speaking on the matter, Tuki expressed relief saying “It is a historic and remarkable judgement which was expected by the people of the country. We have got justice from SC, the court has today saved this country and its Constitution” According to the Supreme Court, “Governor Jyoti Prasad Rajkhowa's decision of advancing the state Assembly session by a month, violates the Constitution and is liable to be quashed”. The decision of restoring Tuki government has been unanimously made by a bench of 5 judges of Supreme Court. The bench headed by Justice JS Khehar said the "clock should be turned back" in Arunachal Pradesh. The Arunachal Pradesh government was dismissed after 21 MLAs rebelled against Nabam Tuki on December 2015; Following which Kalikho Pul was sworn in as Chief Minister on February 19 with the support of Congress rebels and 11 BJP leaders.
