''Not abiding by SC order is disrespectful" says Sisodia on Service Dept remark
The services department said that since The Supreme Court did not abolish the notification issued in 2016, and we did not get any formal order; therefore we will not follow Deputy CM’s order.
New Delhi: The tussle between Delhi government and central government is yet to get resolved even after Supreme Court’s landmark judgement, which it ruled that the LG cannot obstruct Delhi government's policy decisions as he has no independent power and was bound by the elected dispensation's advice; as services department refuse to oblige to Deputy CM Manish Sisodia’s order.
The services department said that since The Supreme Court did not abolish the notification issued in 2016, and we did not get any formal order; therefore we will not follow Deputy CM’s order.
Taking on Service department over their statement, Deputy Chief Minister Manish Sisodia on Thursday said that "How will the government work if officers refuse to abide by SC order"? He further said that even Supreme Court asked LG to cooperate with the government".
Speaking on LG's power, Sisodia said "LG doesn't have a right to view Service department files as per SC order".
The Deputy CM had on Wednesday declared that transfer decisions will be taken by Delhi government.
The court in its order also said that the Lieutenant Governor should not act as an "adversary having a hostile attitude" towards the government, but act as a facilitator, though he was not a "titular head" and differences of opinion between them should have a "sound rationale" without there being any "phenomenon of an obstructionist".
The unanimous judgement by a five-judge constitution bench, headed by Chief Justice Dipak Misra, laid down broad parameters for the governance of the national capital, which has witnessed a bitter confrontation between the Centre and the Delhi government since the Aam Aadmi Party formed government here in 2014.Delhi Govt’s statement on today’s judgement... pic.twitter.com/FSStW3Qjjq
