Amanatullah Khan Gets Relief From Delhi Court In Case Linked To 'Attack On Cops'
The Rouse Avenue Court granted anticipatory bail to MLA Amanatullah Khan on Tuesday. Earlier, the court granted protection to Okhla MLA from any coercive action till February 24.

In a major relief for Amanatullah Khan, a Delhi court on Tuesday granted anticipatory bail to the Aam Aadmi Party (AAP) MLA in a case for allegedly attacking a police team.
Special judge Jitendra Singh said one Shahwez Khan was already on anticipatory bail in the attempt-to-murder case in which police had gone to arrest him.
"No injury has been caused to any of the police official and taking into account the alleged role of applicant, I am of the opinion that anticipatory bail must not be denied, solely on the basis of criminal antecedents," the judge said.
The court noted that Shahwez was in real danger of being in continuous wrongful confinement and, therefore, Khan was protected under Section 35 (right of private defence of body and of property) of Bharatiya Nyaya Sanhita (BNS).
"Even if for the sake of argument, the allegations taken against Khan is taken to be true, the exercise of the right of private defence by the accused Shahwez Khan in escaping from the wrongful confinement and facilitation of the accused Shahwez Khan in exercise of this right by the applicant does not amount to obstruction in the so-called official discharge of duty by the police team," the court said.
The Rouse Avenue Court, while granting bail, ordered Amanatullah to submit a personal bond of Rs 25,000 and directed him to cooperate with the Delhi Police investigation. The court ordered him to appear whenever summoned by the investigating officer and cannot leave the country without the court's permission.
The judge observed the offence alleged against Khan attracted less then seven years, and there was no requirement of custodial interrogation in the case.

The court had also directed Delhi police to bring all the documents aside from any CCTV footage related to the incident before the court on February 24.
An FIR was registered against AAP's Okhla MLA by the Delhi Police for allegedly leading an attack on a police team in Jamia Nagar on Monday. The police said the Amanatulla Khan-led mob helped a proclaimed offender Shabaz Khan, an accused in an attempt-to-murder case, escape from custody.
