Hate Speech Case: Samajwadi Party Leader Azam Khan Gets Regular Bail

After being convicted and sentenced in this case, Azam was disqualified from the Uttar Pradesh Legislative Assembly.

A special MP/MLA court on Tuesday granted regular bail to senior Samajwadi Party leader Azam Khan, who challenged his conviction in a 2019 hate speech case, reported news agencu ANI. After being convicted and sentenced in this case, Azam was disqualified from the Uttar Pradesh Legislative Assembly. Khan's advocate Zubair said special court judge Alok Dubey had granted three-year detainment to the leader on October 27 for delivering hate speech during the 2019 Lok Sabha election campaign.

"Special magistrate court in Rampur has confirmed SP leader Azam Khan's bail. Now he will be on bail and he has been released. He is innocent and the prosecution couldn't prove their case," said Zubair Ahmad Khan, Azam Khan's advocate, quoted ANI.

According to the lawyer, he was granted interim bail at that time and an application for regular bail was made to the court.

He stated that Khan was granted regular bail after the court heard arguments from both sides.

Khan, who represented Rampur Sadar in the Assembly, will be released on bail until the sessions court decides on his petition. On December 5, the Rampur Sadar constituency Assembly by-election is scheduled.

Khan's lawyer Zubair Ahmed said that on October 27, Special Court Judge Alok Dubey sentenced Azam Khan to three years imprisonment for using foul language during the 2019 Lok Sabha election campaign. 

The lawyer said that at that time he was granted interim bail and an application was made in the court for regular bail. He told that after hearing the arguments of both sides, the court granted regular bail to him. Khan, who represents Rampur Sadar in the Assembly, will be out on bail till his plea is disposed of by the Sessions Court. The assembly by-election on Rampur Sadar seat is to be held on December 5.
