Lakhimpur Kheri Violence: SC Will Hear Plea Seeking To Cancel Bail To Ashish Mishra Today

On March 4, 2022, the SC agreed to take up the bail plea on March 11. However, it was rescheduled for March 16, due to an attack on one of the witnesses.

New Delhi: The Supreme Court will hear the plea seeking to cancel bail to Ashish Mishra, son of Union Minister of State for Home Affairs, Ajay Mishra Teni in the Lakhimpur Kheri incident today. Mishra is accused in the case and was granted bail by the Allahabad High Court on February 10, 2022.

The matter will be heard by a bench headed by Chief Justice of India NV Ramana. The CJI said that the SC will constitute the same bench, that was earlier dealing with issues arising out of the Lakhimpur Kheri incident.

On March 4, 2022, the SC agreed to take up the bail plea on March 11. However, it was rescheduled for March 16, due to an attack on one of the witnesses.

Advocate Prashant Bhushan, who is appearing for the petitioner said that one of the prime protected witness was attacked days after Mishra was granted bail. As per Bhushan, the alleged attackers also said that the petitioner 'will be taken care of' as the BJP has returned to power in the state.

Family members of the victims of the Lakhimpur Kheri incident are the petitioners in the case. They have moved the Supreme Court challenging Allahabad High Court order, which granted bail to Ashish Mishra.

Ashish Mishra Teni, son of BJP MP Ajay Mishra Teni had allegedly run over his SUV over the protesting farmers. The incident resulted in the death of four farmers and one journalist among others leading to violence in the region on October 3, 2021. 

“The lack of any discussion in the High Court’s order as regards the settled principles for grant of bail is on account of lack of any substantive submissions to this effect by the State as the accused wields substantial influence over the State government as his father is a Union Minister from the same political party that rules the State,” read the petition as quoted by ANI.
