FIR Registered Against Rahul Gandhi In Assam Over His 'Indian State' Remark

Rahul Gandhi, Leader of Opposition, faces legal trouble for his remarks about the "Indian State." An FIR has been filed against him under sections 152 and 197(1)d of the Bharatiya Nyaya Sanhita.

Legal trouble mounts for Leader of Opposition Party in Lok Sabha Rahul Gandhi as an FIR has been registered against him at Pan Bazar Police Station in Guwahati, Assam, for his recent remark about the 'Indian State.'

The Congress MP, while speaking at the inauguration of the Congress Party's new headquarters in Delhi on January 15, raised questions about the transparency in the electoral process, referring to the assembly elections and said, "We are now fighting the BJP, the RSS, and the Indian State itself."

As per the details shared by news agency ANI, the FIR is registered under sections 152 and 197(1)d of the Bharatiya Nyaya Sanhita for ‘acts endangering sovereignty, unity and integrity of India.'

The complainant, Monjit Chetia, has accused Rahul Gandhi of crossing the limit of permissible free speech and pose a serious threat to public order and national security.

"By declaring that his fight is against the ‘Indian state itself,’ the accused has consciously incited subversive activities and rebellion among the populace. This is an attempt to delegitimize the authority of the state and to portray it as a hostile force, thereby creating a dangerous narrative that could provoke unrest and separatist sentiments,” Chetia said in his complaint.

The complainant further alleged that the MP's remark stemmed from ‘frustration’ over repeated electoral failures.

Earlier, in a post tweeted by the official handle of Congress Party on X (formerly Twitter), Rahul Gandhi said, "Do not think we are fighting a fair fight. If you believe we are fighting against a political organization called BJP and RSS, they have captured almost every institution in our country. We are now fighting not just the BJP and RSS, but the Indian state itself.
 
I clearly stated that something went wrong in the Maharashtra elections. We are uncomfortable with the way the Election Commission operates. The sudden appearance of almost one crore new voters between the Lok Sabha and Vidhan Sabha elections in Maharashtra is problematic......"
