Delhi HC Issues Notice On Umar Khalid's Plea Against Trial Court Order In Constitutional Club Firing Case

The Delhi High Court on Wednesday issued notice in Umar Khalid's petition challenging discharge of two men in attempt to murder case for attacking him at the Constitution Club in 2018.
The former Jawaharlal Nehru University (JNU) scholar and activist Umar Khalid moved the high court against a trial court's order to drop attempt to murder charge against two men who had allegedly fired shots at him outside the Constitution Club in New Delhi.
A bench of Justice Anoop Kumar Mendiratta issued notice to the Delhi Police and the two accused, Darwesh Shahpur and Naveen Dalal. The case will be listed on May 21.
Senior Advocate Trideep Pais appearing for Khalid called the trial court order shocking and told the court that the accused had stalked Khalid and planned the attack on him. He said that the accused also made a video admitting the incident.

In August, 2018 Khalid was shot at outside the Constitution Club. Following this incident the Delhi police arrested Shahpur and Dalal.
In December 2023, Delhi's Patiala House Court discharged the two accused of offences under attempt to murder. The court had noted that the prosecution has not placed on record any material to show the definite intention to cause death on the part of the accused.
The trial court passed the order saying that merely pointing the pistol towards the Khalid would not have resulted in his death. And the prosecution has not said that the accused had to be stopped from pulling the trigger.
