'Uniformity Will Not Lead To Unity': Stalin Writes To Law Commission On Uniform Civil Code

Tamil Nadu CM Stalin wrote to the Chairperson of the Law Commission of India expressing his strong opposition to the implementation of the Uniform Civil Code (UCC) in India. The CM said that  UCC poses a serious threat and challenges the diverse social structure of our society. The CM listed a slew of reasons including Constitutional Safeguards, Federal Structure, Cultural and Religious Pluralism, Social Cohesion, Historical Context, Minority Rights, Socioeconomic Implications and Priority on Harmonious Co-existence for opposing UCC.

In terms of minority rights, Stalin said, “India prides itself on being a secular nation that respects and protects the rights of minorities through Article 29 of the Constitution. The Sixth Schedule of the Constitution also ensures that the tribal areas of States preserve their customs and practices through District and Regional Councils.”

“The UCC, by its very nature, has the potential to disproportionately affect such tribal communities and undermine their right to practice and preserve their traditional practices, customs and identities,” he said.

Further, CM said: “UCC, as it stands, lacks widespread consultation and engagement with the State Governments, religious leaders and community representatives which is crucial to arrive at a well-rounded and acceptable solution.”

The CM said, “We need to acknowledge the fundamental principle that uniformity will not lead to unity and progress in a country brimming with diversity. Our nation's strength lies in its diversity, and we must uphold and celebrate it rather than attempting to homogenize it through the Uniform Civil Code.”
