SC Permits TN To Allot 50% Seats For Govt Doctors In Super Specialty Courses For 2021-2022

The petitioners sought SC to declare GO dated November 7, 2020 as unconstitutional in violation of Article 14 of the Indian Consitution and to order admissions without quota scheme.

Chennai: The Supreme Court on Wednesday permitted the Tamil Nadu government to reserve 50% of seats in super-specialty government medical colleges for government doctors who are in service in the state.

The Bench was hearing a plea challenging the Tamil Nadu government's decision to reserve super-specialty seats in NEET for government doctors. 

On Thursday, the plea came up for hearing before the bench of justices L Nageswara Rao and BR Gavai who said, there is no case made out for continuing the interim protection provided in 2020-21. Hence, the bench said that they are rejecting the petition in that regard, said a report on ANI.

Tamil Nadu will now be at liberty to continue the counseling for the academic year 2021-22 as per the quota mentioned in the government order, it said. 

Further, the court postponed the matter for hearing after vacation.

Meanwhile, the petitioners, who appeared for NEET in 2022, argued that the Tamil Nadu government's decision in 2020 was a violation of Article 14 of the Indian Consitution. Article 14 of the Constitution provides equality before the law.

Further, the petitioners said that until the Court determines the validity of special provisions in super-specialty a uniform policy should be drawn and no reservation shall be created for candidates who are in service at this level.

They also sought SC to declare GO dated November 7, 2020, as unconstitutional in violation of Article 14 of the Indian Consitution and to order admissions without a quota scheme, the report said.
