ISRO Spy Case: Kerala HC Quashes 60-Day Time Limit To Ex-DGP Siby Mathews' Pre-Arrest Bail

Former DGP Siby Mathews is the fourth accused in the 1994 espionage case pertaining to an alleged conspiracy to frame former ISRO scientist Nambi Narayanan and others.

Chennai: The Kerala High Court on Tuesday set aside a 60-day time limit on pre-arrest bail to ex-DGP Siby Mathews as imposed by the Thiruvananthapuram sessions court on August 24. Earlier, the court has several times extended the time limit which was supposed to end on October 24. 

Former DGP Siby Mathews is the fourth accused in the 1994 espionage case pertaining to an alleged conspiracy to frame former ISRO scientist Nambi Narayanan and others.

An update on ANI said: "1994 espionage case involving ex-ISRO scientist Nambi Narayanan | Kerala HC quashes the time limit of 60 days granted by sessions court for the pre-arrest bail to ex-DGP Siby Mathews, who is the 4th accused in the case. HC quashed it while considering a petition filed by Mathews."

Senior Advocate P Vijayabhanu said that the pre-arrest bail granted to Siby Mathews should be turned down as it violates the law set by Supreme Court. Following the law settled by the constitutional bench of the apex court, that says, the life of an order of anticipatory bail should be applicable till the end of the trial and it shouldn't be limited to a stipulated time.

According to an earlier report by this news portal, the Thiruvananthapuram sessions court had held in an order issued on August 24, "After a period of 60 days from the date of this order, the petitioner has to resort to remedies provided in Section 437 or 439 of the CrPC or such other remedies as advised to him."
