Texas Sues US President Biden Admin Over Asylum Rule, Says Phone App Encourages Illegal Immigration

Texas argues the Biden administration is essentially encouraging people to come to the US even though they don’t have a legal basis to stay.

The US state of Texas has filed a lawsuit against President Joe Biden's administration over new asylum rule which allows migrants to set appointments at the US-Mexico border using a mobile app to seek asylum into the country. According to IANS, the state argued that the app known as CBP One doesn’t verify if the migrants seeking appointments qualify for entering the US and essentially encourages people to come to the country even though they don’t have any legal basis to stay.

The lawsuit filed Tuesday is the latest legal salvo attacking various aspects of the administration’s plan to manage migration in the aftermath of the end of a key pandemic-era immigration regulation called Title 42.

Texas argues the Biden administration is essentially encouraging people to come to the US even though they don’t have legal basis to stay.

"The Biden administration deliberately conceived of this phone app with the goal of illegally pre-approving more foreign aliens to enter the country and go where they please once they arrive," Texas Attorney General Ken Paxton said in a statement late Tuesday, reported IANS.

Paxton further accused the Biden administration of encouraging illegal immigration.

The state further argued that more asylum seekers would increase the financial burden of Texas through things like healthcare and education.

According to the news report, the Biden administration is trying to build a more orderly asylum seeking system using the CBP One app, which is the core of the plan.

However, the app has come under severe criticism for its technological and procedural problems since it was rolled out in January.

The Biden administration announced in January that it was ending national COVID-19 emergencies officially on May 11 and so the border restrictions would also end. Title 42 is a COVID-era provision which blocked most of the entry of most asylum-seekers from seeking legal entry into the United States. In March 2020, the Trump administration invoked Title 42, citing the need to stop the spread of COVID-19 across its borders. Title 42, dates back to a 1944 law known as the Public Health Act, which granted US authorities emergency powers to prevent the spread of diseases.
