Supreme Court Directs Calcutta High Court To Transfer SSC Scam Case To A Different Bench

Supreme Court directs recruitment scam cases in Bengal to be transferred from the Bench of Justice Abhijit Gangopadhyay to a different Bench at Calcutta High Court.

The Supreme Court directs Calcutta High Court to reassign proceedings related to alleged irregularities in the recruitment of staff in schools in West Bengal to another judge. The Supreme Court has taken note of an interview given by Justice Abhijit Gangopadhyay, a judge of the Calcutta High Court, to a news channel, and has directed the transfer of recruitment scam cases in Bengal from his Bench to a different Bench at Calcutta High Court, as reported by ANI.

A bench headed by Chief Justice of India DY Chandrachud and Justice PS Narasimha passed the order in view of the fact that Justice Gangopadhyay had given an interview to news channel ABP Ananda about Banerjee while the case concerning Banerjee was being heard by the judge.

The Supreme Court has ordered the reassignment of pending proceedings in the recruitment scam case in Bengal from Justice Abhijit Gangopadhyay's Bench to a different judge of the Calcutta High Court. This decision was made after the top court reviewed a note prepared by Justice Gangopadhyay regarding Annexure P7 and also examined the transcript of the interview that was authenticated on April 26, 2023 by the interpreting officer on the original side of the High Court.

The order was passed on a plea by TMC leader Abhishek Banerjee against the High Court's order for a probe by the CBI and ED into his alleged involvement in the scam.

Banerjee claimed that the judge had expressed his dislike for him in the interview and had made derogatory remarks against judges of the Supreme Court who were considering appeals against his order in the case. This occurred subsequent to the apex court issuing an interim stay on the High Court's order to probe the accused by the CBI and ED. The apex court had previously stayed the High Court's order for the investigation.
