SC To Hear On Feb 3 AAP Mayor Candidate's Plea To Timely Conduct Delhi Mayoral Election

The SC on Friday gave its assent to list for hearing on February 3 a plea of AAP’s mayor candidate Shelly Oberoi seeking directions to ensure the mayoral election in Delhi in a time-bound manner.

New Delhi: The Supreme Court agreed to hear on February 3 a plea by Aam Aadmi Party's (AAP) mayoral candidate Shelly Oberoi to conduct the mayoral polls in a time-bound manner.

According to PTI, the top court on Friday gave its assent to list for hearing on February 3 a plea of AAP’s mayor candidate Shelly Oberoi seeking directions to ensure the mayoral election in Delhi in a time-bound manner.

Senior lawyer Abhishek Manu Singhvi filed the petition on behalf of Shelly Oberoi in the apex court.

A bench headed by Chief Justice D Y Chandrachud took note of the submissions of the lawyer on the early holding of the mayoral poll for MCD, the report added.

“It will be listed on February 3,” the CJI said.

The mayoral election in the national capital was postponed again on Tuesday for the second time this month as the Municipal Corporation of Delhi (MCD) House was adjourned indefinitely following a ruckus created by some councillors.

What Does The Plea Demand

The plea majorly has two demands in relation to the Delhi mayor election which has witnessed continuous hindrance in the MCD House in the last two sittings.

The plea asks to conduct the mayoral election in a time-bound manner and to keep the nominated members aways from the entire election process.

It claims that according to Article 243 R of the Constitution and section 3 of the Delhi Municipal Corporation Act, nominated members do not have the right to vote in the said polls.

What Happened In Previous Sitting

The House was adjourned for 15 minutes after the oaths of aldermen and elected councillors as the session began. During this time, a number of BJP councillors began to enter the House, chanting "Modi, Modi," and raising slogans against AAP chief Arvind Kejriwal.

Senior AAP leader Sisodia also said that the BJP was "running away from the election of the mayor."

"Everyone saw the drama of the BJP. The public had gotten fed up with their rule in the MCD. They gave mountains of garbage to Delhi and ruined the entire capital," Sisodia said.

"First, they avoided MCD elections and when the public showed them the door, they are running away from the election of mayor," he said.

The BJP is aware that an AAP mayor will complete tasks more quickly than it could. He stated that this is not democratic.

The Municipal Corporation of Delhi (MCD) was unable to elect a mayor after the oath-taking ceremony because its proceedings were postponed. This was the second time that the new House convened for the mayoral election but was unable to complete the process.

The Arvind Kejriwal-led party won the MCD elections on December 7 with 134 seats, ending the BJP's 15-year reign in the prestigious municipal corporation and reducing the Congress to nine seats out of 250.

Shelly Oberoi is the AAP's contender for the post of city chairman. The BJP has designated Rekha Gupta. The chosen people for the post of appointee city hall leader are Aaley Mohammad Iqbal and Jalaj Kumar (AAP) and Kamal Bagri (BJP).
