Badlapur Sexual Assault Case: Bombay HC Takes Suo Motu Action, Hearing Today

The court took suo motu cognisance after the incident triggered widespread public outrage and protests across Maharashtra.

The Bombay High Court will hear on Thursday the case pertaining to the incident of sexual abuse of two kindergarten students at a school in Thane's Badlapur. The court took suo motu cognisance after the incident triggered widespread public outrage and protests across Maharashtra.

Reportedly, two kindergarten girls were sexually molested by a housekeeping staff at a school in Badlapur on August 13. The girls were allegedly molested in the school restroom. The First Information Report (FIR) was allegedly filed 11 hours after the parents raised their complaint with the police.

On August 17, the Thane police arrested the 23-year-old school attendant Akshay Shinde, for sexually assaulting two girls. He was sent to police custody till August 26 by a local court.

Many persons have also been arrested in connection with the protests and violence that occured after the incident was reported.

A bench of Justices Revati Mohite Dere and Prithviraj Chavan will hear the matter at 10:30 AM today.

Incidently, on the same day, in a seperate rape case, the Bombay High Court slammed the Maharashtra police over the shoddy probe.

According to a LiveLaw report, the Bombay High Court asked if the Maharashtra Police will investigate cases of crimes against women and children, only after people raise their voices.

"Unless people protest your department won't investigate? Is the State of Maharashtra trying to give us a signal that unless people protest it won't take crimes against women seriously? Everyday we are hearing of some or the other rape or a POCSO case," the report said quoting the Bombay HC bench of Justices Ajay Gadkari and Dr Neela Gokhale.

The court will today hear the Badlapur case as the state of Maharashtra faces violent protests after the case was reported. 

On Wednesday, villagers in the Shinde's village stormed into his house and vandalised the belongings. They also evicted Shinde's family members from the house and forced them to leave the village, reported ABP Majha. 

Accused Shinde, along with his parents and a younger brother lives in a 'chawl' in Badlapur's Kharwai village.
