Atul Subhash Suicide Case: Bengaluru's City Civil Court granted bail to his wife Nikita Singhania, mother Nisha, and brother Anurag. The prosecution intends to challenge the bail.

Bengaluru: Nikita Singhania, wife of Atul Subhash, a senior tech executive who committed suicide recently, her mother Nisha Singhania and brother Anurag Singhania after their arrest by the police.

Atul Subhash Suicide Case: Bengaluru's City Civil Court on Saturday granted bail to Nikita Singhania, her mother Nisha Singhania, and her brother Anurag Singhania in connection with the suicide case of Atul Subhash, an automobile company employee. Atul Subhash, who allegedly ended his life on 9 December, cited harassment by his wife and her family in a 90-minute video and a 40-page death note. The documents revealed demands of Rs 3 crore for a divorce settlement as the reason behind his extreme step.

Public Prosecutor Ponnanna told news agency ANI, "All the three, the wife, brother-in-law, and mother-in-law had come before the Sessions Court for bail and now it's been allowed. We have yet to look into the order in detail. Once the order is looked into in detail, we'll get to know the grounds on which the bail has been granted or the conditions have been imposed. Our side of the argument was that the procurement of them was very difficult. The investigation is still pending..."

"They should have been more diligent in getting the bail order because the investigation is not completed, these petitioners getting the bail. We are not happy with the bail order and it will be challenged," he added.

Earlier, Akash Jindal, counsel for Atul Subhash’s family, argued that the accused wife, Nikita, should not use their child to secure bail. "The criminal nature is accumulating to this procedure, and she can't take advantage of the child. We have sought total custody of the child," Jindal said, as quoted by news agency IANS.

Subhash's father, Pavan Kumar Modi, expressed concerns for the safety of his grandson, claiming, "If the court grants bail to Atul's wife, she can attack the child and endanger his life. If she could drive my son to suicide, she could do the same to the child." According to IANS, he further alleged, "My grandson was an ATM for her. She kept demanding money on the pretext of taking care of him, escalating her demands over time."

The family also revealed that they had filed a habeas corpus petition in the Supreme Court to ascertain the child’s whereabouts. The court directed Uttar Pradesh, Karnataka, and Haryana police to investigate. Subhash’s brother, Bikas Kumar, confirmed, "We are waiting for the January 7 hearing in the Supreme Court regarding the child’s custody."

Kumar expressed satisfaction with the police investigation and their support. "The police have been cooperative, and we have fulfilled their requirements. The matter of child custody is now with the Supreme Court," he said.

Bikas Kumar had lodged a complaint with Marathahalli police in Bengaluru, accusing Nikita Singhania and her family of abetment to suicide. The FIR, filed under Sections 108 and 3 (5) of the Bharatiya Nyay Sanhita (BNS), alleges that the accused taunted Atul in court, demanding Rs 3 crore or suicide as the only options.

Meanwhile, Nikita’s family has accused Subhash of demanding a hefty dowry, which they claim led to the death of her father.

The three accused, initially arrested by Bengaluru Police, were placed in 14-day judicial custody before being granted bail.
