Supreme Court Upholds Bail Granted To Ex-Minister Anil Deshmukh By Bombay HC In Corruption Case

The CBI's special leave petition was denied by a bench that included Justice V Ramasubramanian, Justice DY Chandrachud, and JB Pardiwala.

New Delhi: The Supreme Court on Monday dismissed the CBI's petition challenging the Bombay High Court order granting bail to former Maharashtra home minister and NCP leader Anil Deshmukh in a corruption case involving alleged illegal gratification from bar owners and corruption in police transfers and postings in Maharashtra. The CBI's special leave petition was denied by a bench that included Justice V Ramasubramanian, Justice DY Chandrachud, and JB Pardiwala. 

The CJI informed the Solicitor General of India Tushar Mehta right away that the PMLA case's bail was upheld. The petition was then dismissed abruptly by the bench. 

The bench made it clear in its dismissal of the petition that the High Court's observations will not affect the trial and only address the bail issue. 

Deshmukh was taken into custody on November 2, 2021. In October 2022, the Bombay High Court had before conceded bail to the previous Home Minister in a tax evasion case, which the High Court would not save. However, the CBI case continued to keep Deshmukh in jail.

The 73-year-old Nationalist Congress Party (NCP) leader was arrested in connection with a money laundering case by the Enforcement Directorate (ED) on November 2 in 2021.

The ED’s money-laundering case, registered on May 11, 2021, was based on an FIR registered by the CBI on April 21.

In March 2021, former Mumbai police commissioner Param Bir Singh claimed that the then-home minister Deshmukh had set a goal for police officers to collect Rs 100 crore per month from Mumbai's restaurants and bars.

Similar accusations were made by former assistant police inspector Waze, who was arrested following the discovery of an explosives-laden vehicle near the Mumbai home of industrialist Mukesh Ambani.

In April 2021, the high court ordered the CBI to conduct a preliminary investigation.

The CBI filed an FIR against Deshmukh and others for alleged corruption and abuse of official authority based on this investigation.
