Mumbai Cruise Drugs Case: Bombay HC Exempts Aryan Khan From Weekly Appearance At NCB Office
A single-judge bench of Justice Nitin W Sambre said Aryan Khan would have to inform the investigating officer and provide an itinerary before going out of Mumbai.
New Delhi: Allowing a plea by actor Shah Rukh Khan's son Aryan Khan seeking modification of some of the bail conditions in the Mumbai cruise drugs case, the Bombay High Court exempted him from appearing before the Narcotics Control Bureau (NCB) Mumbai office every Friday.
The Narcotics Control Bureau (NCB) did not oppose the appeal but requested that the exemption be granted with the condition that Aryan Khan should appear before the Special Investigation Team (SIT) probing the matter in Delhi whenever he is summoned, a report in Bar and Bench said.
A single-judge bench of Justice Nitin W Sambre said Aryan Khan would have to inform the investigating officer and provide an itinerary before going out of Mumbai.
"The counsel for NCB places on record reply, and he states that whatever is the modification can be granted in light of para 7 (of NCB reply). Sufficient notice is given. With aforesaid background, condition (i) and (j) stands modified. The applicant shall attend office at Delhi as and when summoned with a 72-hour prior notice," the court said.
Aryan Khan would be summoned as and when his presence is required by SIT for the purpose of investigation either in Delhi or Mumbai, the court said.
Aryan Khan Petitioned Bombay HC To Modify Conditions Of His Bail
Last week, Aryan Khan petitioned the Bombay High Court to modify a condition imposed on him when he was granted bail in the drugs-on-cruise case. Aryan Khan was released from Mumbai's Arthur Road Jail on October 30 after spending 26 days in prison.
Aryan's plea sought a waiver of the condition that he shall be present in person at the Narcotics Control Bureau's (NCB) south Mumbai headquarters every Friday.
"As the investigation has been now transferred to a Special Investigation Team of Delhi NCB, the condition that he appear at the Mumbai office could be relaxed," the petition said.
Mumbai Drugs-On-Cruise Case: Aryan Khan Was Arrested On Oct 3
Following a search on a cruise ship off the coast of Mumbai, Aryan Khan was arrested by the NCB on October 3 on charges of alleged possession, consumption and sale/purchase of drugs. On October 28, the Bombay High Court granted him bail.
In addition, the High Court put 14 requirements on him. He was told, among other things, that he must appear before the NCB every Friday, that he must not leave Mumbai without alerting the agency, and that he must not leave India without permission from the special NDPS court.
