Supreme Court Junks Plea Seeking Re-Election In Haryana, Stay On Swearing-In Of Cabinet

CJI Chandrachud expressed dismay at the prayers in the petition and even warned of imposing costs on the petitioner.

The Supreme Court on Thursday dismissed a petition seeking re-election in 20 assembly seats in the state of Haryana. The top court also refused to stay the oath-taking ceremony of the Haryana cabinet.

"What kind of petitions are these?" Chief Justice of India DY Chandrachud remarked while dismissing the plea.

The matter came up, when the petitioner mentioned the matter for urgent listing in morning in front of CJI DY Chandrachud's bench. The CJI expressed dismay at the prayers in the petition and even warned of imposing costs on the petitioner.

"You want an elected govt to be restrained from taking the oath? We are putting you on guard...we will dismiss the matter with costs," CJI warned the lawyer appearing for the petitioner.

After the counsel insistence, the CJI agreed to take up the matter and directed him to circulate the papers.

After concluding hearings for the day, the comprising CJI DY Chandrachud, Justice JB Pardiwala and Justice Manoj Misra took the matter around 4 PM.

The counsel submitted in the court that he was seeking re-election in 20 Assembly seats because of inaccuracies in the Electronic Voting Machines. He further told the court that the Congress party has given a representation to the Election Commission raising these concerns.

"Taken on board and dismissed," CJI Chandrachud ordered after disapproving of the nature of the prayers in the petition.

The results of Haryana Assembly elections were declared on October 8, where the Bharatiya Janata Party (BJP) emerged as the winner. BJP leader Naib Singh Saini took the oath as the Chief Minister of Haryana today. BJP retained its decade-long power in Haryana with a third straight win in the 2024 Assembly elections, giving a big jolt to the Congress, which was expecting a victory in Haryana Assembly elections.

This year, BJP has given its best electoral performance so far in the Haryana Assembly polls with 48 seats, the last best was 47 seats in 2014.
