File Report On Jamia Plea: Court Directs Delhi Police
A Delhi Court on Wednesday directed the police to file an action taken report (ATR) over the alleged brutality that happened inside the Jamia Millia Islamia University campus on December 15 last year.
New Delhi: A Delhi Court on Wednesday directed the police to file an action taken report (ATR) over the alleged brutality that happened inside the Jamia Millia Islamia University campus on December 15 last year.
Metropolitan Magistrate Rajat Goel passed the directions while hearing a plea filed by the varsity's administration under section 156 (3) Code of Criminal Procedure (CrPC) seeking registration of an FIR against the Delhi Police as it entered the varsity campus without permission and subjected to brutality with the students.
The plea is filed by varsity's Registrar through Advocate Asghar Khan and Tariq Anwar stated that "the Chief Proctor of the University filed a complaint dated 16.12.2019 to the S.H.O Jamia Nagar for registration of FIR and a copy of same was also sent via email on 17.12.2019 to S.H.O Jamia Nagar, DCP South-east and Commissioner of Delhi Police against the unauthorised entry of Police into the University campus, inflicting physical injuries to the students studying in library and damaging the properties of University on 15.12.2019".
"However, till date, no FIR has been registered in this regard," the plea said.
It also said the police filed an FIR in connection with the incident but the said FIR has not been lodged on the basis of the complaint dated 16.12.2019 made by the varsity.
"...the Complainant fully cooperating with the police officials and in compliance of Notice U/s 91 Cr.P.C dated 16.12.2019, furnished 4 pen drives to the Police officials containing CCTV footage of 15.12.2019 and the same were duly seized vide seizure memo dated 27.12.2019," the plea said.
The petition sought directions of the court to the police to register an FIR under section 268 (Public nuisance) 295 (Injuring or defiling place of worship with intent to insult the religion of any class), 295A (Deliberate and malicious acts, intended to outrage religious feelings), 296 (Disturbing religious assembly) , 297 (trespassing on burial places, etc) , 307 (attempt to murder), 323 (voluntarily causing hurt), 338 (causing grievous hurt by act endangering life or personal safety of others) 341 (wrongful restraint) 447 (trespass) and other various sections of Indian Penal Code and under section 3 and 4 of Prevention of Damage to Public Property Act, 1984 and other appropriate laws in the present matter and investigate the same against the accused persons and to carry out a proper and fair investigation.
