Bihar Cabinet's Big Decision On Liquor Ban Law In State - Here Are New Rules
The Surveillance of ethanol-producing grain-based distilleries will be conducted 24 hours a day. Liquor laden vehicles will be allowed to pass with the check posts declared within the state limits.
New Delhi: The government's cabinet has given its nod to the Prohibition of liquor and products rules, 2021 on Wednesday. It clarifies several rules relating to prohibition of alcohol. Now, if alcohol is manufactured, stored, bottled, sold or imported-exported in a complex, the entire complex will be sealed.
However, only the marked portion of residential complexes will be sealed and not the entire premises or entire accommodation. Cantonment area and military station will be allowed to store liquor. No employed or retired military officer outside the cantonment area will be allowed to keep or consume alcohol.
On receipt of the withdrawal proposal, the Collector will pass the order of withdrawal within 90 days of the presence of the effective party giving an opportunity to be heard. Provisions of Section 436 will apply for bail for the first offence. An appeal can be filed against the collector's order on which the production commission has to give a decision within 30 days of filing the complaint.
The departmental secretary will also have to pass the order within 30 days for revision. In case the individual or his advocate does not appear on the scheduled date of hearing in the appeal and revision proceedings, a unilateral decision will be taken by the Presiding Officer based on the available records.
On the other hand, the surveillance of ethanol-producing grain-based distilleries will be conducted 24 hours a day under a CCTV camera. Liquor laden vehicles will be allowed to pass with the check posts declared within the state limits. Such vehicles will be mandatory to exit the state limits within 24 hours in any case. As soon as the liquor laden train enters the state limits on the designated route, it will be digitally locked.
