Bombay HC Adjourns SSR's Sister Plea Seeking To Quash FIR Against Them; Court Expected To Pronounce Verdict On Rhea's Bail Petition Tomorrow
Sushant Singh Rajput Death Case: Bombay HC is expected to take decision on Wednesday in the bail plea of Rhea Chakraborty and four others including her brother Showik Chakraborty.
The Bombay High Court is expected to pronounce its verdict on Wednesday on the bail plea of Bollywood actress Riya Chakraborty, who has been in judicial custody since September 8 for her alleged involvement in buying, using and trafficking of drugs. Besides the bail petition of the 'Jalebi' actress, the court is also expected to take decision on the bail plea of four others including Showik Chakraborty, brother of Rhea. Earlier, a special Metropolitan Magistrate Court had rejected Rhea's bail plea. During the hearing, the investigating agency NCB had opposed Riya Chakraborty's bail plea, saying that Riya Chakraborty is a part of a big drug syndicate. The investigating agency had also argued that that Riya should not be granted bail under section 37 of the NDPS Act, because an arrest under any section of the NDPS Act itself can be considered a serious crime. Referring to a similar decision of the Supreme Court, the NCB mentioned that the Supreme Court has commented in one of its decisions that the purchase of drugs is a bigger crime than killing someone.
On the other hand, Riya Chakraborty's lawyers in his defence had said that the charges and clauses imposed on her are not correct as the NCB has neither recovered any drugs from Rhea not has been able to prove that Riya used to buy drugs. The actress's lawyer kept arguing that whenever Riya asked for the drug, it was for late actor and her live-in partner Sushant.
In another development, the Bombay high court on Tuesday adjourned the petition filed by Priyanka Singh and Meetu Singh for further hearing on October 13. The two sisters of late actor Sushant Singh, had filed a plea seeking to quash the FIR registered against them by Bandra police.

The FIR was lodged by Rhea Chakraborty on September 7, 2020 against two of the four sisters of 'Dil Bechara' actor. Rhea in her complaint had alleged that Priyanka Singh and Tarun Kumar (Doctor at Ram Manohar Lohia Hospital in Delhi) prescribed banned medicine, Clonazepam, to Rajput. She stated that the medicines prohibited under the NDPC Act 1985 were prescribed to Sushant which might have resulted in chronic anxiety and death of 'Chhichhore' actor.
Hearing the case today, the High Court bench comprising justices SS Shinde and MS Karnik posted the hearing as no one appeared for CBI. Moreover, Rhea Chakraborty's counsel sought time to respond to the petition.
