Madras HC Dismisses Plea Challenging Govt Order Providing Quota In PG Medical Admission For In-Service Doctors

Chennai: The Madurai bench of Madras High Court dismissed a batch of petitions challenging Tamil Nadu Government Order (GO) providing reservation to in-service doctors in PG medical admissions in state government and self-financing colleges. The petitioner had requested the court to quash the GO by terming the order 'arbitrary' and illegal. 

On Monday, the petitioner also sought the court to treat in-service and non-service candidates equally in the admission for PG seats. 

According to a report on The Hindu, the case came up for hearing before the bench of Justice GR Swaminathan who dismissed all the petitions. The court noted that the petitioner challenged the GO. 

As per the GO, the state government ordered that 50% of seats reserved for the state government in PG degree courses in Tamil Nadu state-run medical colleges and self-financing colleges under Tamil Nadu Dr MGR Medical University will be reserved for in-service doctors serving in government medical institutions.

The judge said that he declines to go into the contention since the division bench clearly stated that the primary reason for non-interference was the academic year 2021-2022 which was the first year the policy was implemented.

"The Division Bench wanted to see how the implementation would pan out in the future. Therefore, the data collected in respect of the first year of the implementation of the policy cannot be the basis for maintaining this petition. The liberty granted by the Division Bench can be invoked only if the petitioners can show a pattern of disproportionate impact," observed the bench, as per Bar and Bench.
