AAP Rajya Sabha MP Swati Maliwal has levelled serious allegations of physical assault against Delhi Chief Minister Arvind Kejriwal’s personal secretary, Bibhav Kumar. Maliwal claimed that she was physically assaulted by Kumar at the residence of the Chief Minister on 13th May. The Delhi Police has filed an FIR against Kumar under several sections of the Indian Penal Code. IPC Section 354 deals with assault or use of force on a woman with an intent to outrage her modesty; Section 506 provides for punishment against criminal intimidation, Section 509 is invoked against a word gesture or act of intent to insult; Section 323 that has also been added is applied on acts of assault. "One is assault or criminal force, then assault or criminal force on a woman, assault or criminal force to stop a woman from getting out, against a parliamentarian i.e., a public servant also more importantly against a woman which is outraging her modesty by words or by gestures. The seriousness of the offence is like this. Then the minimum punishment starts from one year and goes up till five years." says Lawyer.
