Justice Suresh Kumar Kait has clearly stated about not being inclined to offer relief to Shahrukh Pathan, after which his counsel withdrew the plea, according to the news agency PTI .
The court then dismissed the plea as withdrawn. The accused has sought bail citing reasons that his 76-year-old father is unwell and has no one to look after him. His counsel Asghar Khan also referred to the order granting bail to Jamia student Safoora Zargar on humanitarian grounds, and asked to grant him bail, too.

Justice Kait said, “While committing offence, you forget everyone. Now you are thinking about your aged and ailing parents.” As per the PTI report, the prosecution stated that Pathan was leading the mob which could be clearly seen in the video on record.
"This video was provided to us by a senior journalist from a leading newspaper. He has been examined under section 161 of the CrPC," the prosecution said.
In fact, it stated that the weapon in question belongs to the accused and the same has been recovered from the car that he used for absconding.

"He had purchased this from a man in UP, along with 20 live cartridges," the counsel told the court. After hearing the submissions and examining the documents and evidence, the court remarked that Pathan was trying to lead the mob in order to become a hero.
There have been more than 750 cases registered related to the communal violence that broke out in different parts of north-east Delhi mainly on February 24 and 25. Nearly 100 charge sheets have already been filed in as many cases, so far, according to a report in the Hindustan Times.
