Chief Secretary Assault Case: Delhi Court Issues Notice To Kejriwal, Sisodia On Plea Against Discharge

In 2018, Prakash had alleged manhandling by CM Kejriwal, Deputy CM Sisodia and 11 other Aam Aadmi Party (AAP) MLAs during a meeting at Kejriwal’s official residence.

New Delhi: A Delhi special court has issued notice to Delhi Chief Minister Arvind Kejriwal, Deputy CM Manish Sisodia, and 11 others in the alleged case of assault on former Chief Secretary of Delhi, Anshu Prakash. 

In 2018, Prakash had alleged manhandling by CM Kejriwal and other Aam Aadmi Party (AAP) MLAs during a meeting at Kejriwal’s official residence.

In August 2021, a magisterial court had dropped all charges against the MLAs except two. Charges were only framed against MLAs Amantullah Khan and Prakash Jarwal. 

“Accused persons namely Arvind Kejriwal (A-3), Manish Sisodia (A-4), Rajesh Rishi (A5), Nitin Tyagi (A-6), Praveen Kumar (A-7), Ajay Dutt (A-8), Sanjeev Jha (A-9), Rituraj Govind (A-10), Rajesh Gupta (A-11), Madan Lal (A-12) and Dinesh Mohania (A-13) are discharged in the present case. Whereas, prima facie case for offences under section 186/332/353/323/34 IPC is made out against the accused persons namely Amanatullah Khan (A-1) and Prakash Jarwal (A-2),” held Additional Chief Metropolitan Magistrate Sachin Gupta on August 11, 2021.

Now, Anshu Prakash has filed a revision petition arguing that a “pre-planned conspiracy” was hatched by Kejriwal and Sisodia. The review petition was filed by Senior advocate Sidharth Luthra and advocate Kumar Vaibhav, appearing for Prakash. 

“The Ld Trial Court has failed to appreciate that the Complainant/Revisionist had earned the ire of the CM and his party MLAs since he could not get or give the requisite certifications required for release of TV advertisements. Further, extant DAVP rates were not being accepted by major TV channels and higher rates had not been approved,” states the petition.

Special Judge Geetanjali Goel issued the notice to all respondents of the case which is due to be heard on November 23, 2021.
