States are required to collect statistics on the inadequacy of representation of SCs/STs, according to a three-judge panel led by Justice Nageswara Rao. The Supreme Court stated that state governments must collect quantifiable evidence before giving reservation in promotion to SC/ST employees and that it cannot set any new standards following the Constitution Bench's decision.
