The Supreme Court on Wednesday issued notice to Bhavani Revanna but refused to cancel the anticipatory bail granted to her by the Karanatak High Court. Bhavani who is the mother of suspended JD(S) MP and rape accused Prajwal Revanna, is accused in a kidnapping case involving one of the victims of her son's alleged sexual assaults.
A bench of Justices Surya Kant and Ujjal Bhuyan issued notice to her on the appeal filed by the Karnataka government appointed Special Investigation Team (SIT) challenging a Karnataka High Court order granting her anticipatory bail.
Senior Advocate Kapil Sibal appearing for the Karnataka government told the top court that High Court granting her bail in the kidnapping case was "most unfortunate."
Noting that the accused woman is a 55-year-old, the top court remarked "let us not politicise."
"The accused is a woman who is aged 55 years. There are serious allegations against her son of indulging in atrocious things. He ran away and eventually, he was caught. In a case of this kind of allegations, what will be the role of the mother in abetting the crime committed by her son?" the bench asked.
Sibal however contended that the victim was kept under captivity on the directions of the Revanna family.
The Karnataka High Court on June 18 granted anticipatory bail to Bhavani Revanna.
The high court had found that she was cooperating with the SIT investigating the matter.
