Background
SC Likely To Hear Plea Challenging Prohibition Of Donor Gametes in Surrogacy
The Supreme Court is likely to hear a plea today, challenging the rules issued by the Union Health Ministry that prohibit the use of donor gametes for couples seeking children through surrogacy. The plea argues that these rules undermine the provisions of the Surrogacy (Regulation) Act, 2021, which grants the right of parenthood to infertile couples. The Ministry of Health and Family Welfare published General Statutory Rules (GSR) 179 (E) on March 14, 2023, stating that couples undergoing surrogacy must provide both their own gametes, thereby excluding the use of donor gametes. Single women (widows/divorcees) opting for surrogacy must use their own eggs and donor sperms. The plea contends that these rules violate the constitutional rights enshrined in Articles 14 and 21 and aims to frustrate the objectives of the Surrogacy (Regulation) Act, 2021. The petitioner seeks the quashing of GSR 179 (E) as it is inconsistent with the constitution.
