A suit has been filed in a civil court in Ajmer seeking a declaration that Bhagwan Shri Sankatmochan Mahadev Virajman is the owner of property where the Khwaja Dargah Sahib is located at Ajmer. The suit has sought several firections to Dargah Committee of the Ajmer Khawaja Sahib Dargah, Ministry of Minority Affairs and Archaelogical Survey of India (ASI), contending that the property where the Khwaja Dargah Sahib is located at Ajmer is the property vested in the deity Bhagwan Shri Sankatmochan Mahadev Virajman from ancient time beyond the memory of human being.
The suit filed by Hindu Sena national president Vishnu Gupta has sought a direction from the court to direct the Dargah committee and Ministry of Minority Affairs to remove the "super structure" (Dargah) which he has alleged is raised over a Mahadeva Linga.
The suit further seeks "reconstruction Bhagwan Shri Sankatmochan Mahadev Temple at the place of Mahadeva Linga existing within the property in suit at Ajmer after removal of the present structure there at and to make every arrangement for pooja, bhog, performance of rituals of diety..."
It has further prayed to the court restrain those working for the Dargah committee and government from entering upon or use the aforesaid property in any manner or to make any interference in the pooja and worship and daily rituals of the deity within the property in suit. The suit seeks a direction for demolition of the Dargah and construction of a Temple in its place. Gupta has further prayed for a scientific survey of the property by the ASI.
The suit has contended that the whole of the Dargah appears to be built on the sites of Hindu temple. The suit claims that according to tradition, there is an image of Mahadeva in the cellar where remains if Khwaja were interred. It further claims the "historical accounts" suggests that there existed Jain temple and Mahadeva Temple at the place where Ajmer Sharif Dargah is built.
