Delhi High Court on Thursday said there is a complete failure and it is very clear that systems are not in place. HC remarks came when an advocate told the bench that according to an RTI reply, Delhi Govt did not procure ventilators purchased in the last six months.
HC said the obligation of the State to provide sufficient infrastructure to save the lives of people can't be understated and even the most economically advanced nation have found their infrastructure to be lacking to deal with a massive surge of cases.
"The existing medical infrastructure in the State is being completely exposed when it is put to test. This court cannot turn away the petitioner by merely telling him that the state doesn't have the infrastructure, " HC added.
There are thousands of others who are infected & have an equal claim but these people may not have the resources to approach Court, the bench said. HC says it shall be the obligation of the State to provide beds with ventilator facility.
"Merely because we have passed this order, it does not give any preferential right to the petitioner," the Delhi High Court stated.

This is particularly concerning as children, not just in India but the world over, are not yet being vaccinated against Covid-19.
