Supreme Court To Hear Teesta Setalvad's Case On July 5
On Wednesday, the Supreme Court will hear a petition by social activist Teesta Setalvad challenging a Gujarat High Court order that denied her request for regular bail and ordered her to surrender immediately in a case of alleged evidence fabrication to frame innocent people in 2002 post-Godhra riots cases.
In a rare late-night session on July 1, the Supreme Court saved Setalvad from arrest and postponed the high court ruling for a week.
According to the cause list released on the Supreme Court website on Wednesday, the petition would be heard by a bench comprised of justices B R Gavai, A S Bopanna, and Dipankar Datta.
During the late-night session on Saturday, the three-judge bench questioned Setalvad's denial of time to appeal the high court's July 1 judgement, arguing that even a common criminal is entitled to some type of interim relief.
"In ordinary circumstances, we would not have considered such a request. However, it is to be noted that after the FIR was registered against the petitioner on June 25, 2022 and the petitioner was arrested. This court considering the application for grant of interim bail had granted the same on certain conditions, vide order dated September 2, 2022 . One of the factors that weighed with this court was that the petitioner was a lady and as such entitled to special protection under Section 437 CrPC," the bench had noted in its order.
