SC VERDICT

Decision taken by State Disaster Management Authorities to promote final year students on the basis of previous results and internal assessment is beyond the jurisdiction/ powers under the DM Act and has to give way to the UGC guidelines.
As per the SC verdict, decisions taken by the State Disaster Management Authorities under the Disaster Management Act shall prevail over the UGC guidelines as regards the deadline of 30th Sept, 2020 for conducting final exams.

JEE, NEET Exam Dates to cast a shadon on SC Decision on UGC Exams?
While the verdict is anxiously awaited, many students are worried that the Supreme Court's dismissal of JEE, NEET exams may cast a shadow on the UGC Exam Guidelines case as well. While the petitioners have remained positive, there is still a rising concern about examinations during COVID.
Decision on Final Year Exams in a few minutes from now

In another 10 minutes, the Supreme Court bench headed by Justice Ashok Bhushan would announce the verdict on the UGC Guidelines case, clearing the confusion over whether the examinations would be conducted or not. The SC hearing on UGC Case had concluded on August 18, 2020.
SC Verdict does not guarantee cancellation of exams

While SC Verdict may be in favour of the petitioners, it does not guarantee that all final year examinations would be canceled. The decision has to be taken whether a State Government's order can override UGC Directives. As such, if the order is in favor of the petitioners in the matter of State Governments, if the state government does not cancel the exams, Universities in the state may still continue to conduct the examinations.
Petitioners Seek Cancellation of Exams
The students, in their petition, said the examinations should be cancelled and results of such students should either be calculated on the basis of their internal assessment or past performance.
The Supreme Court had observed that the issue is if the state disaster management authority has decided that the situation is not conducive for holding exams, can they overrule the UGC.

It had said that another issue is whether the commission can override state authorities and ask the universities to hold examinations on given dates.
Arguments given earlier in favour of exams:
Solicitor General Tushar Mehta had also said that it's not in the interest of students to not hold exams. He argued that UGC is the only body that can prescribe rules for conferring a degree, and state governments cannot change the rules. It was also argued that not conducting exams will be against students' future as a uniform admission process will get adversely affected without final year exams
Maharashtra government had informed the Supreme Court on August 7 about the State Disaster Management Authority's decision to not conduct the final exams in the state.
One hour to go for SC's verdict: The Supreme Court will announce its verdict in the much awaited UGC case in an hour and students will finally come to know whether or not they have to take their exams in September.

UGC Guidelines Case LIVE Updates: The Supreme Court's final decision has been announced on the conduct of final year university examinations. The anxious wait of the final year students of universities across India is over, as the Supreme Court has said that Exams are Mandatory but the states can approach the UG for the postponement of Exams. Advocate Alakh Alok Srivastava read out the verdict which said that states can't promote students without conducting exams, therefore exams are necessary. However, it is not compulsory to conduct the exams before Sept 30 keeping in view of the rising coronavirus cases

Amid the Coronavirus pandemic, the students are apprehensive of taking their examinations, as it would require them to travel from their hometowns to their respective universities. The different restrictions in place in different states, adds to the fuss of the students.

The decision by Supreme Court is out today, and the suspense continuing for months ends!

Students have been waiting for clarity and expected the SC to give a decision in the last hearing held on August 18, 2020. But the court had reserved its verdict and given all the parties three days-time to present their final arguments.

On July 6, the UGC had issued guidelines that stated it was mandatory for Universities to conduct the final year exams using any– pen and paper, online, or a combination of both by September 30th, 2020. Soon after multiple petitions were filed against the decision which included a plea filed by 31 students from different states and by Maharashtra's Yuva Sena. The apex court began hearing the case from July 31.
