After the Supreme Court granted interim bail to Delhi Chief Minister Arvind Kejriwal on Friday, the Aam Aadmi Party supremo was seen meeting his wife, Sunita Kejriwal, and mother Gita Devi after spending 50 days under custody. The top court has granted interim bail to Arvind Kejriwal for 21 days in the Delhi Liquor Policy case, in view of the Lok Sabha elections campaigning, which will go on till June 1, asking him to surrender on June 2.
The Delhi CM was arrested by the Enforcement Directorate on March 21, in connection with a case related to alleged corruption and money laundering in the formulation and execution of the Delhi government's now scrapped excise policy for 2021-22.
The interim bail was granted by a bench of Justice Sanjiv Khanna and Justice Dipankar Datta, which noted that "21 days here or there should not make a difference" and that the Delhi CM can surrender after concluding his election campaigning after June 2.
The apex court also stated that it would try to complete the hearing of Kejriwal's petition, challenging the arrest by the Enforcement Directorate at the earliest.
ED on Thursday filed a fresh affidavit before the Supreme Court and opposed interim bail for Kejriwal saying that the right to campaign in polls is neither fundamental nor constitutional. The central agency further contended that Kejriwal is not contesting Lok Sabha polls and no political leader has ever been given interim bail for election campaigning.
Earlier on Tuesday, the Supreme Court had adjourned hearing the interim bail plea. Thereafter, Justice Sanjiv Khanna while presiding over another case stated that the Delhi CM's bail plea will be taken up on May 10, adding that the court is inclined to pass an order on the same day.
On Tuesday, the apex court stated that in case it granted interim bail to the Delhi CM, it does not want him to undertake any official duty as the Chief Minister. In view of this, Senior Advocate Abhishek Manu Singhvi on behalf of Arvind Kejriwal agreed to the Supreme Court's condition, adding that he is willing to present an undertaking for it as well that he will abstain from signing any official files, if granted interim bail.
