The Karnataka High Court recently came across a case where a senior citizen from Bengaluru claimed tha 27 kgs Ganja (cannabis) grew in his backyard unintentionally through pollination.
The high court came across the case of a 67-year-old Bengaluru man named Chandrashekar, who was booked by the police for growing a commercial quantity of cannabis. The man however said that he had no idea about nearly 27 kgs of Ganja growing in the backyard of his home, the Bar and Bench reported.
The man prayed for quashing of the charges against him in the Karnataka High Court. While presenting the case, the counsel appearing for the accused argued in the court that the cannabis might have grown on its own through pollination since the backyard was not in use.
The bench of Justice M Nagaprasanna found it hard to believe that such a large quantity of ganja may have grown on its own, the report said.
The court doubted if the 27 kg 360 grams could have grown unintentionally through pollination. The court pointed out that the Jayanagar locality was like a concrete jungle where cross-pollination was possibly difficult, the report said.
"How is any cross-pollination possible in Jayanagar?” the report quoted the judge saying.
The counsel appearing for the state said that the man had committed a serious offence against the society. However, the counsel representing the accused again argued that the senior citizen was only booked for cultivation and not consumption or sale of the illicit material.
The judge however questioned the motive of the accused behind growing it if he was not consuming it.
"Then why were you growing it? Passion, is it?” the report quoted the judge asking.
Ultimately the court gave the accused some more time to explain how such a large quantity of ganja had appeared in his backyard and listed the matter for further hearing on December 4.
