A Magistrate Inquiry report was submitted on Monday to the Bombay High Court in response to a plea filed by the father of the Badlapur school sexual assault accused, who lost his life in an alleged fake encounter.


A bench comprising Justices Revati Mohite-Dere and Dr. Neela Gokhale read the report aloud in open court on Monday. "It is said that as per the material collected and the FSL reports, the allegations of the parents of the deceased are justified and these five policemen are responsible for his death," the bench said.


According to Live Law, the report concluded that the force used by the officers during the altercation was "unjustified" and directly implicated them in the incident. It also noted the absence of the deceased's fingerprints on the gun, undermining the police’s claim of firing in self-defense, which the report described as "unjustified and suspicious."


The bench was informed by Hiten Venegavkar, Maharashtra's Chief Public Prosecutor with the assistance of Additional Public Prosecutor Prajakta Shinde that the State will act in accordance with law and filed an FIR.


The court was hearing the father’s petition, which sought an investigation into the matter and the registration of an FIR against the involved officers. On September 25, 2024, the court expressed skepticism over the police's narrative, questioning how the accused, described as physically weak, could not be restrained by multiple officers.






It was also remarked that the Assistant Police Inspector who allegedly fired the shot could not justify his inability to handle the situation appropriately. On December 19, 2024, the parents of the deceased informed the court that they had been forced to live on the streets, unable to find employment, and abandoned by their community.
