The President of Supreme Court Bar Association and Senior Advocate Kapil Sibal on Tuesday attacked the Cente government over the newly implemented three criminal laws. Sibal said that under the Bharatiya Nyaya Sanhita (BNS) which replaces the 163-year-old Indian Penal Code (IPC), no bail for two month will become a norm.
"BNS I’ll conceived I’ll thought out If police custody can be spread out for 2months Then No bail for 2months will be the norm Getting rid of colonial era provisions or making it worse !" Senior lawyer said on his X accout.
Three new criminal laws—Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita, and the Bharatiya Sakshya Adhiniyam—came into effect across the country on July 1. They brought in widespread changes in India's criminal justice system and replaced colonial-era laws IPC, CrPC and Evidence Act.
The BNS deals with a wide range of offences and as the name suggests provides for the punishments that one is liable to for committing an offence defined under this code. The Bharatiya Nagarik Suraksha Sanhita (BNSS) replaces the Criminal Procedure Code (CrPC) which was enacted in 1973 and was the primary legislation describing the procedures of law to implement criminal law.
While there have been voices from the opposition that claim that the new criminal law merely replaces the name of previous code and has been done in a hastened manner, the government has maintained that they have done away with archaic colonial laws.
