The Supreme Court on Monday stayed the Karnataka High Court order that allowed board exams for students of classes 5, 8, 9, and 11th standard of the schools affiliated to the State Board. The court also ruled that the results shall not be communicated to parents and shall be kept in abeyance and not be taken into consideration for any purpose.
The bench of Justices Bela Trivedi and Pankaj Mithal slammed the Karnataka government for attempting to create "havoc" and great distress to students and their parents.
The court used strong words to slam the Karnataka government and said that, "it appears that the respondent state is anyhow bent on playing with the future of the students and has caused a lot of physical and mental agony and hardship to students, parents and their teachers as also to the school management.”
The Registered Unaided Private Schools Management Association Karnataka and others had moved the court against the Karnataka government's decision to hold Board Exams for classes 5, 8, 9 and 11. The petitioners alleged that the Karnataka government proceeded with the board exams in an extremely hurried manner.
They challenged the high court order allowing exams and said that the high court did not grant the petitioners any time to approach the Supreme Court against its order.
The top court was also informed that the Karnataka School Polity Accreditation Council on April 6 directed all the schools to compulsorily publish the results before 9 am today (Monday, April 8) to prevent them from getting any relief from the top court.
Taking note of this development the Supreme Court ruled that even if results are declared, they shall be kept in abeyance and shall not be communicated to parents of students who appeared in these exams.
On March 22, the Karnataka High Court allowed the Karnataka government's plea and asked it to hold remaining exams for classes 5,8,9 students. The State had already completed Class 11 Board exams.
