Congress MP from Sitapur Rakesh Rathore walked out of jail on Wednesday after he was granted bail on Tuesday by a local court in Lucknow in a rape case.


The Lucknow Bench of the Allahabad High Court granted bail to the leader on March 11 in a rape case which was filed under Section 64 of the Bharatiya Nyaya Sanhita (BNS).

However, Sitapur police filed a charge sheet on the same day adding Section 69 of BNS (sexual intercourse by deceit), which carries a maximum punishment of 10 years in prison. This development affected Rathore's immediate release forcing him to apply for bail again in a lower court.


Chief Judicial Magistrate Gaurav Prakash on Tuesday granted him bail in the Section 69 case. Two bail bonds of Rs 1 lakh each were furnished on his behalf in court, the Congress MP's lawyer Vijay Kumar Singh said, as reported by news agency PTI.


Rathore was arrested on January 30 and was lodged in Sitapur district jail since then. He is accused of raping a 45-year-old woman under the pretext of marriage and promising to help her in her political career, according to police and prosecution.


The Congress MP was addressing a press conference to clarify his stance on the allegations when he was taken into custody from his residence by the police.
