SC To Pronounce Verdict On Whether Royalty On Minerals Is Tax Under Mines & Minerals Act Today 


The Supreme Court is set to pronounce its verdict on Thursday at 10:30 a.m. on whether the royalty payable on minerals is a tax under the Mines and Minerals (Development and Regulation) Act, 1957.


The apex court will also decide if only the Centre has the vested power to levy such taxes or the state governments also possess the authority to impose taxes on the land bearing minerals that comes in their territory.


The verdict will be pronounced by a nine-judge Constitution bench headed by Chief Justice DY Chandrachud.


The verdict was reserved on March 14 after hearing a batch of 86 appeals filed by different state governments, mining companies and public sector undertakings for eight days.


The bench also comprising Justices Hrishikesh Roy, Abhay S Oka, BV Nagarathna, JB Pardiwala, Manoj Misra, Ujjal Bhuyan, Satish Chandra Sharma and Augustine George Masih, according to the notice issued by the Supreme Court on its website. 


In the previous hearing, Attorney General R Venkataramani, appearing for the Centre, had contended that the government had overriding powers with regard to taxing mines and minerals.


"The MMDRA wholly occupies the field and provides for a complete code covering every aspect of regulation and development of mines and minerals, including any Government exaction/ imposition in relation to mines and minerals thereby necessarily limiting state legislature’s competence to impose any other levy beyond what is stipulated under MMDRA and the rules framed thereunder," Solicitor General Tushar Mehta, also representing the Centre, had submitted.

Former US president and Republican presidential candidate Donald Trump said he would meet Israeli PM Benjamin Netanyahu at his Mar-a-Lago residence in Florida on Thursday.


Netanyahu is in Washington and will address a joint session of the US Congress, becoming the only foreign leader to do so for a fourth time.


"Looking forward to welcoming Bibi Netanyahu at Mar-a-Lago in Palm Beach, Florida, on Thursday (July 25)," Trump said in a post on Truth Social, a social media platform.


This would be Trump's first meeting with a foreign head of state after becoming the Republican presidential nominee, earlier this month, on July 18.
